Terms of service

These terms describe the agreement between your board and BoardSites (Ken Badertscher, sole proprietor, Massachusetts). By signing in or paying a subscription, your board agrees to what’s below. If something here looks off for your situation, email us first — we’re happy to talk through it.
What we offer
BoardSites is a website and productivity suite built for Massachusetts public retirement boards. The subscription includes hosting, your public site, your private admin tools, document storage, automated PERAC-aware content support, and reasonable email support during business hours. The pricing tiers and the features included in each are described on the pricing page.
Your account
Your board designates administrators by giving them sign-in access. Administrators are responsible for keeping their credentials safe and for the actions taken under those credentials. Sharing one administrator account between multiple people is discouraged — each person who needs access should have their own login so changes are attributable.
Acceptable use
Don’t upload malware, harvest content from other boards on the service, send unsolicited bulk email through us, or use BoardSites to host material unrelated to your board’s public purpose. If you discover a security issue, please email us privately at ken@boardsites.app before disclosing it publicly so we can fix it.
Payment
New subscriptions begin with a thirty-day free trial. After the trial, we bill monthly or annually via Stripe at the tier you selected on the pricing page. Annual subscriptions are billed in advance with a fifteen percent discount versus monthly. We’ll email you before any auto-renewal.
Changing or canceling
Your board can change tiers or cancel at any time from the administrator console or by emailing us. When you cancel:
- Your public site continues serving for the remainder of the current billing period.
- We’ll keep your content available for export for thirty days after the subscription ends.
- After thirty days we delete your data; database backups age out on the schedule documented in our privacy policy.
If something goes wrong
BoardSites is provided “as is.” We work hard to keep it up — see our public status page — and we’ll make reasonable efforts to fix issues quickly, but we don’t guarantee uninterrupted service. To the extent permitted by Massachusetts law, our total liability for any claim arising from your use of the service is limited to the fees your board paid us in the twelve months before the claim.
Changes to these terms
We may update these terms over time. If a change is material we’ll email administrators and post a notice in the admin console at least thirty days before it takes effect. Continued use of the service after the change indicates acceptance; if you don’t agree, you can cancel before the effective date.
Governing law
This agreement is governed by the laws of the Commonwealth of Massachusetts. Disputes that can’t be resolved informally will be filed in the state or federal courts located in Middlesex County, Massachusetts.
